Overview
Understanding VAT and freelancer classification is crucial for Edurs. Here’s what you need to know.
Income Tax Responsibility
Mentoring on Toedur is not freelance work (Freiberuflich) because:
- Edurs follow Toedur’s rules and operate within its marketplace framework.
- Services provided are advisory, not professional consulting requiring certification.
- Toedur processes payments, limiting Edurs' independence as freelancers.
Small Business Exemption (Kleinunternehmerregelung)
If total revenue is below €22,000/year, Edurs qualify for the Kleinunternehmerregelung:
- No VAT charges required.
- Simplified tax filing (only report net income).
- Still required to file an income tax return (Einkommensteuererklärung).
Filing Your Annual Tax Return
All Edurs must submit a tax return, including:
- Income from Toedur under Sonstige Einkünfte (Miscellaneous Income) if under the VAT threshold.
- Expenses related to mentoring (e.g., internet, equipment).
- Failure to file may result in fines, penalties, or visa issues.
When is VAT Registration Required?
VAT registration is mandatory if:
- Annual revenue exceeds €22,000.
- Revenue is expected to exceed €22,000 in the next year.
How to Register for VAT ?
- Complete the Fragebogen zur steuerlichen Erfassung (Tax Registration Form).
- Submit it to your local Finanzamt.
- Receive your VAT ID (Umsatzsteuer-Identifikationsnummer).
- Begin charging 19% VAT on all mentoring services.
After Registering for VAT ?
- Include 19% VAT in your service prices.
- Submit VAT returns (Umsatzsteuervoranmeldung) regularly.
- Deduct eligible expenses (Vorsteuer) to reduce tax liability.
- Remit collected VAT to the Finanzamt.
Visa-Specific Considerations for VAT
- Student Visa Holders: Allowed if within visa work limits.
- Erasmus Students: Must align with scholarship rules.
- Blue Card Holders: VAT applies once income crosses €22,000.
- Non-Residents: Must check home country tax obligations and German VAT laws.
